These Terms of Use and Service ("Terms") are a binding agreement between you and Tommy Hulihan, Inc. ("Tommy Hulihan Basketball," "we," "us," or "our"). They govern your use of tommyhulihanbasketball.com and its subdomains (the "Site"), and your registration for and participation in any league, camp, clinic, training program, tryout, or event we operate, including the Beaches Basketball League, Summer League, Sports Camp, Player Development, and Shooting School (each a "Program").

By using the Site or registering for a Program, you agree to these Terms. If you do not agree, do not use the Site and do not register.

1. Who may use the Site

You must be at least 18 years old to create an account, register a participant, or make a payment.

If the participant is under 18, the registration must be completed by that participant’s parent or legal guardian. By registering a minor, you represent that you are that minor’s parent or legal guardian and that you are authorized to accept these Terms, the participation waiver, and all program policies on the minor’s behalf.

Children may not create accounts or submit information to us directly. All information about a minor participant must be submitted by that participant’s parent or legal guardian.

2. Your account

Some parts of the Site require an account. You agree to:

  • provide accurate, current, and complete information;
  • keep your login credentials confidential;
  • notify us promptly at info@tommyhulihanbasketball.com if you believe your account has been used without your permission; and
  • accept responsibility for activity that occurs under your account.

We may suspend or close an account that we reasonably believe has been used to submit false information, to register a participant the account holder is not authorized to register, to interfere with the Site, or to violate these Terms.

3. Registration, placement, and rosters

Registration is an offer, not a guarantee of a spot. A registration is not final until we accept it and payment is completed. Programs have limited capacity. If a Program is full, your registration may be placed on a waitlist. If a spot opens, we will send one payment link, and you will have the time stated in that message to claim it before the spot is released.

We control division, team, and roster placement. Division eligibility is based on the participant’s grade, age, gender, and school as applicable to the Program. We may verify this information and may move or remove a participant whose registration information is inaccurate.

Teammate and coach requests are not guaranteed. You may submit requests during registration. We consider requests but do not promise to honor any of them, and we may decline a request for balance, roster size, scheduling, eligibility, or any other operational reason. Do not register in reliance on a request being granted.

Coach and volunteer roles are discretionary. Volunteering to coach does not entitle you to a coaching assignment. Coaching and volunteer roles may require a background check, and we may decline or revoke any role at our discretion.

4. Fees and payment

Program fees are shown at registration. Unless stated otherwise:

  • A nonrefundable online registration fee is added to each registration.
  • Optional add-ons, such as cancellation protection, are priced separately and are nonrefundable.
  • Prices are in U.S. dollars.
  • You are responsible for any applicable taxes.

Payments are processed by Stripe. We do not collect or store your full card number, card security code, or bank account credentials. Payment card information is submitted directly to Stripe through Stripe’s hosted checkout, and Stripe’s terms and privacy policy govern that processing. You authorize us and Stripe to charge the payment method you provide for the amounts shown at checkout.

If a payment fails, is reversed, or is charged back, we may suspend the registration and remove the participant from the roster until the balance is resolved. You are responsible for any fees we incur from a chargeback that is later resolved in our favor.

5. Refunds and cancellation

Registration fees are nonrefundable except as expressly stated in this section or in the Program-specific policy shown at checkout.

  • Cancellation protection. If optional cancellation protection is offered and you purchase it at registration, you may cancel before the Program’s first scheduled session or game and receive a refund of the registration price. The cancellation protection charge and the online registration fee are not refunded.
  • Without cancellation protection. Registrations are nonrefundable.
  • If we cancel. If we cancel a Program before it begins and do not offer a substitute, we will refund the registration price. The online registration fee is not refunded.
  • Individual sessions and games. No refund or credit is issued for a session or game that a participant misses, for a game canceled or shortened due to weather, facility closure, officiating, forfeit, or circumstances outside our control, or for a participant removed under Section 6.
  • Season shortened or moved. If a Program is shortened, rescheduled, relocated, or modified after it begins, we will make reasonable efforts to deliver comparable value. No refund is owed for such changes.

Refund requests must be sent to info@tommyhulihanbasketball.com. Approved refunds are returned to the original payment method. Do not initiate a chargeback before contacting us.

6. Participation waiver and code of conduct

Participation is conditioned on a completed waiver. Before a participant may take part in any Program, the participant’s parent or legal guardian must review and accept our Participation Agreement, Assumption of Risk, and Release of Liability. That agreement is presented during registration, is incorporated into these Terms by reference, and controls over these Terms on any matter it addresses.

Code of conduct. Participants, parents, guardians, coaches, volunteers, and spectators must:

  • treat players, coaches, officials, staff, and facility personnel with respect;
  • follow the rules of the Program and of each venue;
  • refrain from abusive, threatening, harassing, discriminatory, or violent conduct; and
  • refrain from being present at a Program activity while impaired.

We may issue a warning, suspend, or permanently remove any person for conduct that violates this section. No refund is issued for a removal under this section.

Health and safety. You must not send a participant to any Program activity when the participant is ill, injured, or has not been cleared to return following a suspected concussion or other injury. You must disclose any medical condition, allergy, or medication relevant to safe participation.

7. Photography and media

We may photograph and record Program activities and use those images and recordings for Program operations, recaps, schedules, rosters, social media, and promotion of our Programs. We do not sell participant images to third parties.

To opt a participant out, send written notice to info@tommyhulihanbasketball.com. Opt-out applies going forward; it does not require us to recall materials already published. We cannot control photography by other families or by spectators at public venues.

8. Schedule changes, weather, and facilities

Schedules, rosters, venues, start times, and officiating assignments may change. We will communicate changes through the Site, email, or text message.

Programs take place at third-party facilities, and facility rules apply. We may cancel, delay, shorten, relocate, or reschedule any activity for weather, lightning, facility closure, staffing, safety, or any other reason. Section 5 governs refunds in those cases.

9. Communications

By registering, you agree that we may contact you by email and text message about your registration, payment, schedule, roster, safety notices, and Program operations. These are transactional messages and are not marketing. Consent to phone-verification texts is collected separately when you request a code under the SMS Phone Verification Terms and Conditions below.

We do not use the phone-verification request to enroll you in promotional text messages.

You consent to receive notices, agreements, waivers, and receipts electronically, and you agree that your electronic acceptance has the same legal effect as a handwritten signature under the Florida Uniform Electronic Transaction Act.

SMS Phone Verification Terms and Conditions

When you ask us to verify your phone number, you consent to receive one-time transactional verification-code text messages from Tommy Hulihan Basketball at the number you provide. We use these messages only to confirm that you control the number. Consent to phone-verification texts is not consent to receive promotional or marketing text messages.

Message frequency varies based on your verification requests. Standard message and data rates may apply. Carriers are not liable for delayed or undelivered messages. For assistance, reply HELP to the number from which you received the message or contact us at info@tommyhulihanbasketball.com. To stop receiving verification messages, reply STOP at any time. If you stop verification messages, you may be unable to complete a feature that requires a verified phone number unless you use another available verification method or contact us for assistance.

We use Twilio to deliver and validate verification codes. When you submit a code for validation, the app transmits that user-entered code to Twilio; we do not store verification codes. Our handling of phone numbers and service-provider data is described in our Privacy Policy.

10. Acceptable use of the Site

You may not:

  • access any account, roster, registration, or administrative area you are not authorized to access;
  • scrape, crawl, harvest, or bulk-download Site content, rosters, schedules, or contact information;
  • use another family’s information to register, edit, or view a registration;
  • interfere with, probe, overload, or attempt to disrupt the Site or its infrastructure;
  • upload malware or attempt to bypass any security or access control;
  • use the Site to send unsolicited messages to other families; or
  • use the Site for any unlawful purpose.

We may investigate suspected violations and may suspend access, remove content, and report conduct to law enforcement.

11. Our content

The Site and its content — including our name, logos, brand, page design, text, graphics, schedules, standings, statistics, and photographs — are owned by us or our licensors and are protected by intellectual property law. You may view and print Site content for your personal, non-commercial use in connection with your own registration. You may not otherwise copy, republish, distribute, or create derivative works from it without our written permission.

12. Information you submit

You retain ownership of the information you submit. You grant us a non-exclusive, royalty-free license to use, store, reproduce, and display that information as needed to operate our Programs — including building rosters and schedules, communicating with families, processing payments, and maintaining records.

Information about other people. Registration lets you submit information about other individuals, including emergency contacts and the names of other children in teammate or coach requests. You represent that you have the authority to provide that information. Do not submit sensitive information about another family’s child beyond what a teammate or coach request requires.

You are responsible for the accuracy of what you submit. We may edit or remove submitted content that is inaccurate, offensive, or inappropriate.

13. Third-party services

The Site relies on third-party providers, including payment processing, hosting, database, email, and analytics services, and may link to third-party sites. We do not control third-party services or sites and are not responsible for their content, availability, terms, or privacy practices. Our use of these providers is described in our Privacy Policy.

14. Disclaimers

The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, that schedules or rosters displayed will be accurate at all times, or that defects will be corrected.

Athletic activity carries risk. We do not warrant that any Program is free from risk of injury. Nothing in this section limits or replaces the Participation Agreement described in Section 6.

We do not provide medical services or medical advice, and we do not provide medical, accident, or health insurance for participants.

15. Limitation of liability

To the fullest extent permitted by Florida law:

  • We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to the Site, these Terms, or any Program, even if we were advised of the possibility of those damages.
  • Our total aggregate liability arising out of or relating to the Site and these Terms will not exceed the total amount you paid to us for the Program giving rise to the claim during the twelve months preceding the event that gave rise to the claim.

These limitations do not apply to liability that Florida law does not permit us to limit, including liability for gross negligence, willful misconduct, or personal injury to the extent Florida law prohibits such a limitation. Claims arising from personal injury during Program participation are governed by the Participation Agreement described in Section 6.

16. Indemnification

You will indemnify, defend, and hold harmless Tommy Hulihan, Inc. and its officers, directors, owners, employees, coaches, volunteers, and agents from any claim, demand, loss, liability, or expense, including reasonable attorneys’ fees, arising out of your use of the Site, your breach of these Terms or of any Program policy, information you submitted about another person, or conduct by you, your participant, or your guests at a Program activity.

17. Disputes

Talk to us first. Before filing any claim, send a written description of the dispute to info@tommyhulihanbasketball.com and give us 30 days to resolve it informally.

  • Governing law. These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules.
  • Venue. The exclusive venue for any dispute is the state or federal courts located in Duval County, Florida, and you consent to personal jurisdiction there.
  • Jury waiver. To the fullest extent permitted by law, each party knowingly and voluntarily waives any right to a trial by jury.
  • No class actions. To the fullest extent permitted by law, claims may be brought only in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
  • Attorneys’ fees. The prevailing party in any action to enforce these Terms is entitled to recover reasonable attorneys’ fees and costs.
  • Time limit. Any claim arising out of or relating to these Terms or the Site must be filed within one year after the claim accrues, to the fullest extent permitted by law.

18. Changes to these Terms

We may update these Terms. When we do, we will change the "Last updated" date above and post the revised Terms on the Site. Material changes will be communicated by email or through the registration flow before they take effect. Continued use of the Site or participation in a Program after the effective date of a change means you accept the revised Terms. The version of the Terms in effect at the time of your registration governs that registration.

19. Suspension and termination

We may suspend or terminate your access to the Site or to any Program, with or without notice, for a violation of these Terms, for conduct covered by Section 6, for nonpayment, or where required by law or by a facility. Sections 11 through 20 survive termination.

20. General

  • Entire agreement. These Terms, together with the Privacy Policy, the Participation Agreement, and any Program-specific policy shown at checkout, are the entire agreement between you and us regarding the Site and the Programs.
  • Order of precedence. If there is a conflict, the Participation Agreement controls on matters of risk, release, and medical authorization; the Program-specific policy shown at checkout controls on fees and refunds for that Program; these Terms control on everything else.
  • Severability. If any provision is held unenforceable, it will be limited or removed to the minimum extent necessary, and the rest of these Terms remain in full force and effect.
  • No waiver. Our failure to enforce a provision is not a waiver of it.
  • Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
  • No third-party beneficiaries, except that the individuals and entities identified as released or indemnified parties may enforce the provisions that benefit them.
  • Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including weather, natural disaster, facility closure, utility or network failure, labor disruption, public-health order, or government action.
